At Skhema, our goal is to help individuals, teams, and collectively organizations, formulate business strategies in order to compete, grow and survive. Our customers, and you, our users, place a significant level of trust in “us” to perform tasks that contribute to future organizational performance. To enable Skhema to perform our stated functions, we need to keep our products and services running smoothly, quickly, and without distraction. We need you not to misuse or abuse our products and services.
To describe exactly what we mean by “misuse” or “abuse” – and help us identify such transgressions, and react accordingly – we’ve created this Acceptable Use Policy. Under this policy, we reserve the right to remove content that is inconsistent with the spirit of the guidelines, even if it’s something that is not forbidden by the letter of the policy. In other words, if you do something that isn’t listed here verbatim, but it looks or smells like something listed here, we may still remove it.
You’ll see the word “services” a lot throughout this page. That refers to all websites owned or operated by Skhema, and any related websites, sub-domains and pages.
Here’s what we won’t allow:
(a) Compromising the integrity of our systems. This could include probing, scanning, or testing the vulnerability of any system or network that hosts our services. This prohibition does not apply to security assessments expressly permitted by Skhema
(b) Tampering with, reverse-engineering, or hacking our services, circumventing any security or authentication measures, or attempting to gain unauthorized access to the services, related systems, networks, or data
(c) Modifying, disabling, or compromising the integrity or performance of the services or related systems, network or data
(d) Deciphering any transmissions to or from the servers running the services
(e) Overwhelming or attempting to overwhelm our infrastructure by imposing an unreasonably large load on our systems that consume extraordinary resources (CPUs, memory, disk space, bandwidth, etc.), such as:
(i) Using “robots,” “spiders,” “offline readers,” or other automated systems to send more request messages to our servers than a human could reasonably send in the same period of time by using a normal browser
(ii) Going far beyond the use parameters for any given service as described in its corresponding documentation
(iii) Consuming an unreasonable amount of storage for music, videos, pornography, etc., in a way that’s unrelated to the purposes for which the services were designed
(a) Misrepresentation of yourself, or disguising the origin of any content (including by “spoofing”, “phishing”, manipulating headers or other identifiers, impersonating anyone else, or falsely implying any sponsorship or association with Skhema or any third party)
(b) Using the Services to violate the privacy of others, including publishing or posting other people's private and confidential information without their express permission, or collecting or gathering other people’s personal information (including account names or information) from our services
(c) Using the Services for any illegal purpose, or in violation of any laws
(d) Accessing or searching any part of the services by any means other than our publicly supported interfaces (for example, “scraping”)
(e) Using meta tags or any other “hidden text” including Skhema’s or our suppliers’ product names or trademarks
(f) Accessing, using, or otherwise exploiting the Services for purposes of competing with or disparaging Skhema or the Services, including but not limited to benchmarking, monitoring availability, performance, or functionality, or conducting competitive analysis
(g) Commercially selling, reselling, licensing, sublicensing, distributing, or framing the Services to a third party unless authorized by Skhema in writing
(a) Using the Services in any manner that supports or is intended for:
(i) Formulating or facilitating any criminal activity, including but not limited to acts of terrorism
(ii) Supporting the operating functions of an entity that may be classified as a cult, or scam
(iii) Inciting, promoting or supporting discrimination against others, especially when based on race, religion, sex, sexual orientation, age, disability, ancestry or national origin
(iv) Inciting, promoting hostility or violence
(v) Selling or promoting illegal activities, products, or services
(vi) Fraudulent or promoting fraudulent activity
(vii) Exploiting vulnerable persons, classified as, but not limited to:
a. a Child or Children
b. an individual aged 18 years and above who is or may be unable to take care of themselves, or is unable to protect themselves against harm or exploitation by reason of age, illness, trauma or disability
c. persons experiencing financial hardship, socio-economic hardship, intellectual disadvantages or any other factor that increases the likelihood an individual may be treated unfairly or taken advantage of
(a) Posting, uploading, sharing, submitting, or otherwise providing content that:
(i) Infringes Skhema’s or a third party’s intellectual property or other rights, including any copyright, trademark, patent, trade secret, moral rights, privacy rights of publicity, or any other intellectual property right or proprietary or contractual right
(ii) You don’t have the right to submit
(iii) Is deceptive, fraudulent, illegal, obscene, defamatory, libelous, threatening, harmful to minors, pornographic, indecent, harassing, hateful
(iv) Encourages illegal or tortious conduct or that is otherwise inappropriate
(v) Attacks others based on their race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or medical condition
(vi) Promotes or creates a risk of physical or mental harm, emotional distress, death, disability, or disfigurement to yourself, any person, or animal
(vii) Promotes or creates a risk of harm, loss, or damage to any property;
(viii) Contains viruses, bots, worms, scripting exploits, or other similar materials
(ix) Is intended to be inflammatory
(x) Could otherwise cause damage to Skhema or any third party
(xi) Violates the rights of any individual or third party, including their intellectual property and data privacy rights;
(xii) Contains any information or content that you do not have a right to make available under any law or due to confidentiality, contractual, or fiduciary duties;
(xiii) Contains any information or disinformation that is false, deceptive, or misleading or otherwise promotes, endorses, encourages, or facilitates the spread of false information;
(xiv) Violates any applicable law or promotes activities that are illegal in nature;
The Services are not intended for, and should not be used by, anyone under the age of eighteen years old. By using the Service, You represent and warrant that You are at least eighteen years old.
To the extent You use the Services to publish or otherwise make available content, You must comply with any notices received from the Arts Law Centre of Australia or as ordered under the Copyright Act 1968 (Cth) or similar statute in other countries. It is Skhema’s policy to respond to valid notices of claimed intellectual property infringement. If Skhema receives a notice alleging that material on any page made publicly available infringes or misappropriates another party’s intellectual property, Skhema may take any remedial action it deems necessary.
In this Acceptable Use Policy, the term “content” means: (1) any information, data, text, software, code, scripts, music, sound, photos, graphics, videos, messages, tags, interactive features, or other materials that you post, upload, share, submit, or otherwise provide in any manner to the services and (2) any other materials, content, or data you provide to Skhema or use with the Services.
If You encounter content or user behaviour that You believe violates this Acceptable Use Policy, please report it to us at the email below.
Without affecting any other remedies available to us, Skhema may permanently or temporarily terminate or suspend a user’s account or access to the services without notice or liability if Skhema (in its sole discretion) determines that a user has violated this Acceptable Use Policy.
If a user has, or Skhema reasonably suspects based on documented evidence that user has, violated any law or regulation, Skhema may report such violations to the appropriate law enforcement officials, regulators, or other third parties. Skhema’s reporting may include disclosing relevant Customer information. Skhema also may cooperate with appropriate law enforcement agencies, regulators, or other third parties to help with the investigation and prosecution of illegal conduct by providing network and systems information related to alleged violations of this Acceptable Use Policy.
Skhema may revise this Acceptable Use Policy from time to time to reflect changes to technologies, industry practices, regulatory requirements, or as we deem necessary. Any such revision will be effective immediately unless your Agreement states otherwise.
